DJ SERVICES AGREEMENT


PRIMARY TERMS OF AGREEMENT


This agreement is between [NAME] also referred to as “the client” per this contract, and Avery Young, also known as “DJ A1”, to provide professional disc jockey services for an event on [DATE], during the hours of [TIME], located at [ADDRESS].


DJ A1 agrees to the following terms:


  1. To provide professional disc jockey services for the full duration of the scheduled event. DJ A1 agrees to arrive at the venue at least one hour before the start time of the event; or a time agreed upon by both parties.


DJ A1 also agrees not to leave the event until the scheduled end time of the event, or the designated time frame per the contract. DJ A1 also agrees to attend any required sound checks or event rehearsals in a punctual fashion.


  1. DJ A1 will follow the proper protocols for the dynamics of the particular event. This includes birthday shoutouts, event announcements, special words/ceremonies, or other appropriate actions for the benefit of the event.

  2. DJ A1 will supply a complete sound system, unless a sound system is provided, which in either instance, will be set up and tested prior to the event start time.

  3. DJ A1 agrees to notify the client of any situation which would make him late arriving to the event or otherwise off schedule.

  4. DJ A1 agrees not to consume alcohol beyond a reasonable limit, or to abstain altogether if requested or it would be deemed inappropriate for the event; as to not hinder the ability to provide effective services. DJ A1 also agrees not to engage in any other inappropriate or otherwise unnecessary actions that would disrupt the event.

  5. The right to deny any requests or actions that violate Federal, State or Local laws and/or statutes or ordinances. DJ A1 resides in the Commonwealth of Kentucky, and this contract is under the jurisdiction of that state as it pertains to this event.


The Client agrees to the following terms:


  1. The financial agreement for this contract of service is $XXXX. This may be paid in cash, or digitally via Zelle or Square Cash App. Certified checks are accepted upon prior notification. The full payment amount must be collected before the start of the event, with the exception of school/university and related entities with a check processing system.

  2. The client must pay a non-refundable 25% deposit within seven (7) days, or earlier of the event date [DATE] to secure services for the event. DJ A1 reserves the right to renegotiate the terms of agreement and/or hourly rate if the deposit is not received within the allotted time frame. This clause may be excused for school/university accounts with a check processing system. Full payment must be received within seven (7) business days of the event date in this circumstance.

  3. The client will incur/reimburse the costs of any additional equipment required for the event; including lights, fog machines, additional speakers, party favors, etc., unless a special arrangement has been made. Such arrangements will be attached to this contract and considered an extension of this contract.

  4. The client will provide a tracklist or media files within ten (10) days of the event, or within two (2) days of the event for an event scheduled sooner than ten (10) days, if needed.

  5. The client will arrange for a parking space for the DJ’s vehicle and pay/reimburse the cost thereof, if any.

  6. The client must designate themselves and/or a predetermined point of contact as the sole persons with authority to give directions to DJ A1 with respect to music selection, microphone control, announcements, and breaks, if any. DJ A1 reserves the right to deny any music requests from event attendees. DJ A1 will not plug in any phones, or other media devices other than the personal computer and DJ controller provided with this service.



ADDITIONAL TERMS OF AGREEMENT


  1. Upon a request from the client to play longer than the allotted time, DJ A1, at his discretion, may perform overtime at the rate of $75 per hour, and payment is due immediately upon request. This time will be sold by the hour only, and cannot be renegotiated in the event of unforeseen circumstances.

  2. As stated above, the 25% deposit fee is non-refundable. The only circumstance that will result in a fully refunded deposit is an emergency situation of his own accord where DJ A1 will not be able to provide the services as planned. There are no refunds to the client for deposits or services except by a lack of service provided. DJ A1 agrees to issue any funds eligible for return within five (5) business days.

  3. If the event is delayed as a result of DJ A1’s late arrival, the client has the option to either extend the show/event by double the amount of time delay, or reduce the fee on a pro rata basis according to the time lost. Except to the extent of compensation previously paid by the Client under this contract, DJ A1 is not responsible for the inability to perform due to accident, injury, or equipment failure where the Client is liable, or other conditions reasonably beyond his control.

  4. If DJ A1 experiences an equipment breakdown and is not able to finish the event, the fee will be paid on a pro rata basis determined by the length of playing time. This will not apply in the case of damage to equipment that is caused by an attendee or an incident at the event. To cover any such claims, the Client may obtain a single event liability insurance policy.

  5. This contract constitutes the entire understanding between the parties, and there are no covenants, promises, representations, or warranties other than as set forth herein. No modification of its terms will be valid unless they are recorded in a written instrument signed by both parties. In the event any provision of this agreement is determined to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

  6. This contract will be interpreted according to the laws of the Commonwealth of Kentucky. In the event of breach of Contract, DJ A1, at his discretion, may take legal action against the client. The contract implies that a court may award attorney fees, court costs and related expenses to the prevailing party.

DAMAGED/STOLEN EQUIPMENT


In the event that any equipment is damaged or stolen by an event guest or the client, and the client does not have a single event liability insurance policy, the client agrees to pay 75% of the retail value for the damaged/stolen equipment. The following list is the current retail value of DJ A1’s equipment:

FAQ's


  1. Do you provide a complete sound system for the event? Do I need to provide anything?

Yes. You may provide your own lighting if you wish, but your audio needs are 100% covered.


  1. Do you have clean music? This is for a kids birthday party, my church, somewhere with children, etc.

Yes, with a small asterisk. While there is a plethora of "clean music" that is available that I can provide and have provided for previous events; modern hip hop music tends to be hit or miss when it comes to clean tracks being available. In occasional instances, some very specific popular songs may not be able to be played at your event due to no clean version of the song being made available.


  1. Can you find [an obscure song from the 70's-00's]?

I will do my absolute best to track down any song for your event, but similar to Q2, with older music, it can also be difficult to track down a specific song in respectable quality. Sometimes this is due to how songs were previously recorded before the mp3 era. I will make you aware of anything that I cannot find before the event.

  1. What does the Sound Engineer do?

The sound engineer functions as an assistant to ensure that the audio systems provided for the event sound good. As the DJ, my point of view is from behind the speakers, which isn't an accurate representation of the sound. The sound engineer saves everyone a lot of time and trouble in figuring out how loud the system needs to be before and during the event. The sound engineer is considered a necessary part of my service and is non-negotiable.


  1. Can the photographer provide pictures/videos specifically for my wedding/event?

No, the photographer provided with this service will only provide supplemental photography to the event as they are a part of my service. If you have not hired a photographer for the event, I cannot guarantee any specific pictures for the event from my photographer. The pictures taken by my photographer may also be used for portfolio purposes.


  1. Who is the rapper/singer listed with your services?

  1. How do you prioritize bookings?

Bookings are reserved on a first come, first serve basis, upon receiving a completed contract AND a deposit for services. I strongly encourage every client to send the deposit and contract back at the same time to avoid any confusion.


  1. Can I just pay everything in cash on the day of the event?

Typically, no. Reserving your booking via deposit is the only way to lock in your date unless no deposit is required for your event. In the event that no deposit is required, full payment must be made upon arrival.


  1. What if I pay a deposit and my event gets canceled?

Deposits are non-refundable, except in the event that I cannot render services to you at all. Unlike many DJ companies, you do not owe me anything else if your event falls through. For events postponed due to inclement weather or unforeseen circumstances, your deposit is still active and you may reschedule with no additional charges, as my schedule permits.


  1. Why do you upcharge for events that are last minute, or after the deposit window?

Two Reasons. Firstly, with all due respect, your emergency is not my emergency. I have no problem coming to save the day when things go awry, but that means I now have to move my schedule around to accommodate your needs. My schedule is often set months in advance, and even on weekends where I'm not gigging, I'm often out networking and attending events of other business partners and colleagues. The commitments I've made to those individuals are as important to me as the commitment you'd like me to make to you. For me to prioritize your event over another non-gig event, yes the financial incentive must be present.

Secondly, in the event that you've contacted me about an event 3-6 months ago and have not signed a contract or paid a deposit, the terms of agreement are clearly defined. The rationale stems back to the answer above; my time and the time of others are just as valuable as yours. I intentionally give a healthy window of time to return contracts, especially for weddings to avoid conflicts such as this. Thank you for your understanding.
